GAINESVILLE, Fla. (WCJB) -Diyonne McGraw has filed a lawsuit against Governor Ron DeSantis challenging her removal.
Following the removal, Alachua County School Board members are meeting for the first time without McGraw.
DeSantis declared her seat vacant after it was revealed that McGraw resides in District 4 instead of the district she represented, which was District 2.
McGraw’s lawsuit claims that only a judge can remove a sitting elected official. Her lawyer declined all requests to comment before court.

According to a third party attorney, Mark Herron, DeSantis has the power to vacate McGraw’s seat given the circumstances.
Herron also stated that her lawsuit will likely have no effect on the current executive order.
Supporters of McGraw lined up before the meeting with signs and posters, protesting the executive order. In addition, four Sheriff’s Deputies were standing by.
McGraw was seen at the meeting as a spectator.
